Our Mission

Brooklyn Defender Services is a public defense office whose mission is to provide outstanding representation and advocacy free of cost to people facing loss of freedom, family separation and other serious legal harms by the government. We believe in a client-centered approach and work, in and out of court, to uphold the rights, freedom and dignity of people threatened by unjust, racist and harmful legal systems.

With your support, Brooklyn Defender Services (BDS) delivers comprehensive legal services and critical advocacy to over 23,00 people in Brooklyn every year. Our dedicated team works across BDS’ core practice areas and specialized units to provide wrap-around support that addresses the housing, education, mental health, and other essential daily needs of our clients.

In 2024, we expanded our community education initiatives to ensure Brooklyn residents are prepared for and can safely defend their rights during encounters with the police, Administration for Children’s Services (ACS) and Immigration and Customs Enforcement (ICE). Your commitment furthers our impact and allows us to meet the growing needs of our clients with care and expertise.

Looking ahead, our work remains urgent. New Yorkers are increasingly threatened by laws and policies that aim to harm and destabilize them, making our legal and advocacy efforts more critical than ever.

With 29 years of leadership in public defense, BDS is uniquely positioned to challenge the unfair and punitive systems that enforce these harmful policies. We are advancing campaigns like the Youth Justice & Opportunities Act (YJO), which focuses on investing in young people's futures by addressing the criminal legal system's harsh collateral consequences, and the Family Miranda Act, which empowers families and shrinks pathways into the family policing system.

While we are optimistic about the progress ahead, we know it can only be achieved with you by our side. We are grateful to move forward together in this new year. Thank you for all you do to empower and protect vulnerable communities across New York City.

Community Engagement

BDS is deeply committed to empowering the people and communities we serve.

In 2024, we collaborated with local community-based organizations, educational institutions, elected officials, and directly impacted people to expand our community education and engagement initiatives—broadening our reach and ensuring Brooklyn residents had access to the support they needed throughout the year.

Our deepest gratitude to our partners whose collaboration and dedication helped us advance our shared mission to protect and support the people and communities we serve.

  • We hosted and participated in more than 40 community engagement and campaign events reaching over 1,500 participants. From leading Know-Your-Rights workshops to reconnecting with community members through the reopening of our Community Office in East New York Brooklyn, we worked to deliver comprehensive social and advocacy support to the people we serve. We also distributed essential items through resource events, including our Back-to-School Resource Fair, Annual Holiday Toy Drive, and Winter Coat Giveaways.
  • In partnership with JMACforFamilies, we launched a public awareness campaign to inform families about their rights when facing investigation by the Administration for Children’s Services (ACS). Campaign ads appeared inside MTA buses in Brooklyn neighborhoods that are heavily targeted by ACS and connected families to YourFamilyYourRights.org, where they could access critical information and connect with legal support. Through this campaign, we aimed to empower parents with information about their rights, reduce the harm of ACS investigations, and, most importantly, help keep families safely together.
  • Led by our Reentry Team, our Reentry Speaks Loud and Clear (RSLC) support group brings together the people we represent, community members, and partner organizations to foster connection, exchange resources, and build a robust support network among people. Last year, more than 120 participants attended RSLC events at our Community Office—an inspiring reflection of the collective commitment to successful reentry. Our Reentry Team provides year-round support to people who are currently or formerly incarcerated as they navigate the challenging journey of returning home and rebuilding their lives—this includes assistance with securing stable housing, finding gainful employment, and accessing educational and therapeutic programming.
  • BDS’ Pro Bono Team hosted two Small Business Academy sessions in 2024, in collaboration with Start Small Think Big and our longtime pro bono partner Cleary Gottlieb Steen & Hamilton LLP. This joint pro bono initiative equips aspiring entrepreneurs and current small business owners with legal tools and resources to support the growth and sustainability of their businesses. It is an important first step in addressing the resource gap faced by many of our clients as they build and advance small businesses.

Criminal Defense

We defend people accused of crimes in need of an attorney and fight for the best outcome for them. Our staff meet with every client to understand who they are and the charges brought against them. We explore all opportunities to reduce collateral consequences, advise our clients of their options and defend them at trial when needed. To address the unique needs of the people we serve, our Criminal Defense Practice has specialized units that provide targeted services to adolescents, clients with mental illness, women, veterans, and clients with overlapping criminal, family court, and immigration issues.

Mr. R

When Mr. R lost his job during the COVID pandemic, he became discouraged and isolated, ultimately relapsing after a period of sobriety. Mr. R was arrested and incarcerated on Rikers Island. While in jail, Mr. R completed all of the available programming while his lawyer and social worker searched for resources in the community. Mr. R’s social worker found him a bed in a holistic, residential substance use program and his attorney successfully argued for him to be released from jail and into treatment while his case progressed. Due to his success in the treatment program, R’s case was positively resolved and he is now living in transitional housing, gainfully employed, and working toward getting his own apartment.




“When I lost my job I became discouraged and let everything go. My experience working with Brooklyn Defenders was very beautiful. My social worker brought a program to my attention–it was exciting–I never had that type of opportunity to go to a program and get myself together. This was my shot and I was going to do it right. Everything fell into place and all the dots were connected.”

Family Defense

BDS’ Family Defense Practice is the primary provider of representation to parents who are investigated or prosecuted by NYC’s Administration for Children's Services. The primary goals of our representation are to provide high quality legal representation to parents in high stakes family policing investigations and family court cases and to ameliorate the underlying issues that drive families into this system, such as lack of access to quality health and mental health treatment, basic necessities, and appropriate education and services for children with disabilities.

In 2024, we represented 2,323 parents and caregivers in ACS investigations and family court proceedings.

“Brooklyn Defenders helped me fight for my family for years. They kept me resilient. When no one else was listening, I knew my attorney and social worker heard me and that I wasn’t fighting by myself. I’m relieved that my case is over and I'm free to be a parent and watch my kids run, laugh, and play.”

Tatyanna is an emerging advocate for families who has endured the trauma of family separation, having been removed from her family as a child and then facing the removal of her own children. BDS advocated alongside Tatyanna for over 12 years, supporting her in fighting to keep her family together through hearings and case conferences, while she navigated programs and services. After years of fighting for her family, Tatyanna no longer has ACS in her life and her bonds with her children are lovingly intact. She has navigated these systems with courage, tenacity, hopefulness and insight and she and her family are thriving.

Immigration

We protect the rights of immigrant New Yorkers by defending against ICE detention and deportation, minimizing the negative immigration consequences of criminal and family court charges for non-citizens, and representing immigrants in applications for immigration benefits. We are one of three New York Immigrant Family Unity Project (NYIFUP) providers, which specializes in representing people who are detained and facing deportation.

Skarlett

“I don't have the words to describe how grateful I am that Brooklyn Defenders was my immigration team. My amazing attorneys and social worker took my experiences seriously and did everything in their power to get the best results in my case and also helped me to address other challenges in my life. I'm now a paralegal and eager to help other people like they helped me."

Skarlett was a lawful permanent resident of the US, but was detained by ICE and put into deportation proceedings nearly a decade ago. Her BDS immigration attorney successfully fought for Skarlett to be released from detention, so she could be home with her family while her case was in court. It took five years of advocacy from her immigration team before her immigration case was successfully dismissed in 2022. With the support of her legal team, Skarlett filed for naturalization, and in 2024 became a US citizen.

Civil Justice

We reduce the civil collateral consequences for clients who have had interaction with the criminal legal, family policing or immigration systems. Through legal advocacy in court and with government agencies, we assist people in remaining in their homes, maintaining their public benefits, staying in school, and keeping their job. Our Civil Justice Practice handled 3,080 cases in 2024.

King

“From my immigration and housing attorney, to my social worker and the support staff, everyone at Brooklyn Defenders is helpful. High priced lawyers wouldn’t do what the public defenders will do for you. The defenders are connected to the community, they care about you.”

While speaking with a BDS immigration attorney, King disclosed that he was representing himself in housing court and was facing an imminent eviction. His attorney immediately referred him to BDS’ Civil Justice Practice. Working together, King’s housing attorney, social worker, and benefits paralegal helped King apply for a housing voucher to cover future rent, secure rental arrears payments, and represented him in housing court and secured a dismissal of the eviction case. King and his family are now able to stay in their home and maintain the rent.

Policy & Advocacy

We work to eliminate and reduce the harmful impacts of the criminal legal, family policing and immigration systems and to expand access to housing, and employment for those impacted by these systems. Working with our practices, we harness the expertise within Brooklyn Defenders and the direct experiences of the people we represent to effect systemic change. Through participation in local, state and national coalitions, legislative advocacy, litigation, community education, and communications strategies, we work to amplify the voices of impacted communities and to change laws that threaten the rights of the people we represent.

  • We took a momentous step in our fight against mass surveillance in the city’s jails and communities, with the introduction of Council Member Gale Brewer’s End Correctional Community Surveillance (ECCoS) Act which will end the universal recording of calls made to or by people in NYC jails and ban the collection of biometric and location data.
  • We also made progress towards modernizing New York’s Commission on Forensic Science, by working with the state legislature to introduce a bill that will make the Commission more independent, accountable, and transparent, while strengthening the reliability of forensic science evidence used in criminal courts.
  • We brought our legislative advocacy to the community, by participating in a Youth Justice Speak Out in the Bronx, and a Youth Justice Resource Fair in Brooklyn.
  • Our staff testified at dozens of city and state hearings on issues that directly impact the people we represent, including the need for health care professionals–not police–to respond to mental health crises, the prevalence of sexual violence in NYC jails, commonsense policies to safeguard against wrongful conviction, and the harms perpetuated by false reports to the New York Statewide Central Register and family separation.
  • We organized and attended a dozen advocacy days where our staff educated lawmakers on our legislative priorities including bills that will reform New York’s sentencing laws, narrow entryways into the family policing system, and promote youth justice.
  • We co-presented the panel “Family Separation: How Family and Criminal Courts Contribute to the Separation of Families and the Transformative Legislative Campaigns Fighting for Change” at the SOMOS Conference in San Juan, Puerto Rico.

Brooklyn Defenders Releases Revealing Report on NYPD Surveillance Technology

In December 2024, we released a report analyzing nine years of the NYPD’s ShotSpotter gunshot detection technology performance data that we obtained via a Freedom of Information Law request. Our analysis confirmed what we’ve long suspected–ShotSpotter fails to make our communities safer, at the expense of increased surveillance and policing of Black and Latine neighborhoods and tens of millions of dollars.

Civil Rights & Law Reform

The Civil Rights & Law Reform Unit works across BDS’ practice areas to identify and target barriers that impede access to justice for the people BDS represents in the criminal, family, and immigration legal systems, with a focus on confinement. Through federal and state litigation on behalf of both classes and individual people, we challenge government policies and practices that systematically harm the people we serve.

  • BDS continued as co-counsel on a lawsuit filed on behalf of a mother and her minor child who have endured three years of invasive investigations by ACS at their home and the child’s school triggered by anonymous and baseless reports made to the New York Statewide Central Register. In 2024, we successfully opposed the city’s motion to dismiss, allowing the bulk of the claims to continue.

  • BDS together with the Bronx Defenders, New York County Defender Services, and pro bono counsel, Cleary Gottlieb Steen and Hamilton LLP, filed a class action lawsuit against the Department of Correction (DOC) to end universal call recording at city jails and the unlawful mass surveillance system that collects biometric and personal data along with those recordings. This lawsuit comes after DOC unlawfully recorded thousands of privileged telephone conversations between people in DOC custody and their defense attorneys—and then sent those recordings to prosecutors and law enforcement.

  • Along with other NYC defender offices, we filed an amicus brief in Nunez v. City of New York in support of the New York City Council and Public Advocate's lawsuit challenging Mayor Eric Adams’ emergency executive orders that suspended parts of Local Law 42 of 2024, which banned solitary confinement and many other abusive DOC practices in city jails.
  • We filed an amicus brief on behalf of community organizations and legal service providers in Hodge v. Mayorkas advocating for a requirement that immigration courts conduct a bond hearing for people who remain in mandatory immigration detention after six months.
  • BDS continued as co-counsel in Agnew v. New York City Department of Correction, a litigation filed in October 2021 alongside The Legal Aid Society and Milbank LLP to ensure those in city jails are provided access to medical care. In 2024, we filed a third contempt motion against DOC for their continued failure to provide access to medical care, resulting in thousands of missed medical appointments, deteriorating medical conditions, and dangerous situations for people in custody.

Pro Bono

BDS’ Pro Bono Unit leverages resources for clients through an expansive network of strategic partnerships with New York’s major private law firms. We partner with firms on individual cases, advise our staff or help think through strategic litigation. We also work to educate the private bar to raise awareness of the systemic injustices our clients and communities face every day.

Client Services

BDS’ Client Services team supports clients who visit our Client Services Center and manages the distribution of direct relief items and other essential support including clothing for clients who are incarcerated and families living in shelters, emergency groceries, and hygiene items. We provide phones and data plans for clients who rely on this technology to stay connected with their support systems and access treatment programs, as well as transportation assistance to help clients attend job interviews, workforce training, school, and court appearances.
